These terms of use apply to the use of J.O.E., the analysis suite of Jaeckert & O’Daniel GbR (“we”), including AI Visibility, Brand Sentiment, SEO tools, the account, team features and the free GEO check. The contracting party is Jaeckert & O’Daniel GbR, represented by Fabian Jaeckert and Benjamin O’Daniel, Freiherr-vom-Stein-Straße 2a, 54550 Daun, info@jaeckert-odaniel.com. The legal notice is published on jaeckert-odaniel.com.
The service is directed exclusively at entrepreneurs within the meaning of section 14 of the German Civil Code (BGB).
Service
J.O.E. shows how brands, products and domains appear in AI answers and in organic search. This includes prompt research, GEO analyses, sentiment evaluations, SEO reports, monitoring and sharing report links. The exact scope depends on the plan you book. Results come from queries to third-party providers and from our evaluation. They are a snapshot. They are not a guarantee of rankings, revenue or a particular presentation in ChatGPT, Claude, Google or any other system. They do not replace legal, tax or individual marketing advice.
Account
An account is created through a magic link sent to the email address you provide, or through an invitation to an existing team. You are responsible for protecting your means of access and access to the mailbox linked to your account in an appropriate way. If you suspect unauthorised access, tell us without delay.
You are responsible, within the limits of the statutory rules, for activity that results from unauthorised access for which you are accountable.
Team members can see the analyses of the shared organisation or shared workspace. You manage roles and invitations in the account, where your plan allows teams.
Prices and payment
Paid plans run through Stripe as a subscription. The prices on the pricing page at the time of purchase apply, plus statutory VAT where it is due. Stripe collects the name, billing address and, where relevant, the VAT ID at checkout. You manage invoices and cancellation at the end of the period in the Stripe customer portal.
The subscription renews for the agreed period until you cancel it in the customer portal. Cancellation takes effect at the end of the period already paid. Free Community access through the Academy ends when the membership ends and does not affect a separately paid subscription.
Your content
Keywords, prompts, brands and other input remain your content. You grant us the right to store it, reproduce it and transmit it to the analysis services named in the privacy notice, to the extent needed to run the analysis, monitoring and support. Those services receive the subject of the analysis and the texts required for it. We do not transmit the email address, name or account ID with those calls.
J.O.E. is for the analysis of brands, products and domains. Personal data of third parties must not be entered. The service is not intended for that.
You make sure that you are allowed to use the content you enter and that no third-party rights and no duty of confidentiality are infringed. Do not enter special categories of personal data in J.O.E., such as health data or data about criminal offences.
We do not use your content or account data to train our own AI models. How the analysis services handle the texts we send them is set out in their linked terms. We may reuse the same specialist search queries in a technical cache. That cache does not contain account data.
Our rights
The software, interface, website copy and the way results are prepared remain with us or our licensors. You receive a simple, non-transferable right to use J.O.E. for the term of the contract within the scope of the booked plan. You may pass report links to people who are meant to read the report. Reselling access, or automated bulk extraction outside the intended features, is not allowed.
Acceptable use
You use J.O.E. in a way that keeps the service available to others. In particular, the following are prohibited:
- attacks on availability, circumvention of quotas, or access to other people’s accounts
- introducing harmful content
- use for unlawful purposes
If you breach these rules, we may block access, stop individual runs and terminate the contract for cause. Statutory rights remain in place alongside this.
Availability and support
We operate J.O.E. with the care of a proper SaaS service. We do not promise a specific level of availability on the standard plan. Maintenance, outages at Vercel, Neon, Railway or the analysis services, and force majeure may interrupt the service. You can reach support at info@jaeckert-odaniel.com.
Privacy
We process account data as described in the privacy notice.
Liability
We are liable without limitation for intent and gross negligence, for culpable injury to life, body or health, and under the German Product Liability Act (Produkthaftungsgesetz).
In cases of ordinary negligence we are liable only for a breach of a material contractual duty. Material contractual duties are duties whose performance makes the proper performance of the contract possible in the first place and on whose observance you may regularly rely. In these cases our liability is limited to the damage that was foreseeable when the contract was concluded and that is typical of the contract.
Otherwise, liability for damage caused by ordinary negligence is excluded.
We give no warranty for the accuracy, completeness or continued availability of content and results created or supplied by third-party systems. The liability rules above apply accordingly to decisions you take on the basis of analyses or reports from J.O.E.
The limitations of liability above also apply for the benefit of our legal representatives and persons we use to perform our obligations.
Term and end
A paid contract runs for the period chosen at checkout and renews until you cancel it in the Stripe customer portal. Cancellation takes effect at the end of the period already paid. Access to paid features then ends. After the contract ends, stored analyses may be kept for a further 90 days and then deleted, unless statutory retention duties prevent that. Statutory retention, in particular for invoices, remains in place. The right to terminate for cause without notice remains unaffected.
Changes to these terms
We may update these terms when features, the law or service providers change. We will tell you about material changes with reasonable notice by email or in the account. If you do not object by the stated date and you continue to use J.O.E. afterwards, the new terms apply. The notice will point out the right to object and the consequences. If you then cancel, the contract ends at the end of the current period.
Final provisions
The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods. Mandatory consumer-protection rules of the country in which a consumer has their habitual residence remain unaffected. If the customer is a merchant, a legal entity under public law or a special fund under public law, the place of jurisdiction is Daun.
If a provision is invalid, the rest of the contract remains in effect. The invalid provision is replaced by the statutory rule.
